Trying to keep this simple: when someone makes an adult film, they are paying people to have sex. Sometimes the “film maker” also participates in sex, thus becoming (in effect if not by law) a John.
Why is the act of performing sex on film for money not considered prostitution? Isn’t this a loophole in the law? Theoretically, one could hire a prostitute, film the sex act, and if caught, claim that one is merely making an adult movie.
Or am I totally missing something about how the law distinguishes between these two things?

Dear Matt,
The main difference between the two that you have mentioned in your is this.
Movie making is a licenced business with regulations in place
verses the free lance operation of others in unregulated free lance prostitution.
In the case of pornographic film making actors are medically
screened for disease whereas the private free lance prostitutes are not required. Nevada’s privately owned prostitution houses do have medical testing but they are
neither film makers or free lance operators.
In the pornographic film industry the actors are paid in full for
their acting services under contract whereas the private prostitute has no guarantee of payment.
And lastly..there are safeguards for the actors safety when making a film and no protection for the free lance prostitutes
who are frequently physically abused or killed.
I hope that this answer will help clear up any questions.

I am by no means a Porn Industry expert. But on the surface it would seem that anyone who obtained a legal permit to operate a business filming porn, it IS a legitimate business, would be within the law as far as ‘paying’ it’s actors to have sex. You are paying for the acting, not the sex, I suppose.
I would equate it much like Hollywood racing cars down L.A. streets while filming a movie. The proper permits and safety measures required by law are in place, traffic laws can be broken, legally, all for the sake of a movie being made.
It could easily be viewed as a ‘loophole’ and I imagine strict regulation would keep the average ‘madam’ from running a brothel under the guise of a ‘movie enterprise’.

It would seem that any John would be wise to carry a camera when doing business with a prostitue. I don’t think you’re missing anything. Freedom of speech does not protect every form of speech. You cannot yell fire in a movie theater. At least there was a time when you couldn’t.

Pornography has been declared a PROTECTED form of “free speech” as an “art form”.
The difference is that a prostitute is paid to personally/directly give sexual gratification…. the porn star is paid to be filmed while performing sexually explicit acts.

personally porn stars can still live a life
the people are stringed and so forthe
really being a porn star is an art somewhat
but prostitution isnt
and its full of all kinds of illegal things
drugs and so forth
so to me at least porn is somewhat monitored.
oh yeah porn star make so much more money
per act I think…….

This would be a good question for a Philosophy class. I have always wondered how people can have sexuality on daytime tv shows, tv movies, and in films, and then arrest prostitutes as many are poverty victims and are drug addicts. I did read all the answers and you have many different answers. I think that America has a hypocritical attitude to the area of prostitution and sexuality as these poor women who live like slaves in prostitution as mainly slaves to drug habits and often beaten up and or killed. The Hollywood Movie stars are worshipped and it is like two different worlds, an inigma???
